The 2024 legislative sessions have ended in all but a handful of states, with the exception of emergency sessions. Overall, there was far less activity this quarter on the regulation of scanning technology at the point of sale for tobacco and alcohol products compared to the last 2 years. However, progress has been made in some states. Here are the updates and new laws to look forward to in Q4 of 2024 and throughout 2025.
New ID scanning laws in California
California SB 495 | Alcoholic beverage delivery
California SB 495 would prohibit any licensee from delivering alcohol until the age of both the purchaser and recipient are 21 years or older.
This bill is currently under review and has yet to be voted on as of August 15, 2024.
New ID scanning laws in Illinois
Illinois SB 3098 : Public Act 103-0937 | Prohibiting the online sale of e-cigarettes
This new law prohibits retailers from selling e-cigarettes, vapes, or other electronic tobacco products online to anyone under the age of 21.
This bill was signed by the Governor on August 9, 2024 and goes into effect on January 1, 2025.
New ID scanning laws in Michigan
Michigan HB 6002 | Increased fines and penalties for selling tobacco to minors
This new law would increase fines and penalties to up to $3000 per incident and license revocation.
The bill was referred to the Committee On Families, Children And Seniors on September 26, 2024.
New ID scanning laws in New Hampshire
New Hampshire SB 502 | Allowing real estate brokers to scan IDs
This new law allows real estate brokers to scan, record, retain, or store information collected with a license holder’s consent for a period lasting until the closing date or upon the license holder’s request.
This bill was signed into law on July 26, 2024 and goes into effect on January 1, 2025.
New ID scanning laws in New Jersey
New Jersey AB 1813 and SB 3372 | Prohibiting delivery of electronic cigarettes to anyone under 21
These laws would prohibit the delivery of electronic smoking devices to anyone under 21 and for those 21 years and older, a signature would be required at the time of delivery.
Both bills were reported to the senate on October 7, 2024 with amendments.
New ID scanning laws in Pennsylvania
Pennsylvania SB 117 | ID scanning for anyone appearing under 35 to purchase alcohol
This bill would require any establishment selling alcoholic beverages to scan the ID of any patron that appears to be under 35 years of age prior to alcohol purchase with the exception of an armed forces card.
This bill was laid on the table on September 17, 2024.
