Pennsylvania SB 688 | Allowing the sale of canned cocktails

Pennsylvania recently signed SB 688, also known as Act. 86, into law which allows approved retailers to sell canned cocktails along with other beers and liquors. This new bill states every Pennsylvania Liquor Store shall sell liquors, including wine and ready-to-drink cocktails, at wholesale to hotels, restaurants, clubs, and railroad, pullman and steamship companies licensed under this act; and ready-to-drink cocktails to distributors and importing distributors that hold a ready-to-drink cocktail permit. This new bill goes into effect on September 15, 2024.

What you need to sell canned cocktails under Pennsylvania SB 688

Other than an approved permit by the state, an ID scanner and accompanying software are both needed by establishments planning to sell canned cocktails. Sb 688 explicitly states:

“A ready-to-drink cocktail permit holder shall utilize a transaction scan device to verify the age of an individual who appears to be under thirty-five years of age before making a sale of a ready-to-drink cocktail.”

Simply put, this means all businesses will need to employ the use of an ID scanner with age verification technology on any customer who looks under the age of 35 before completing the sale. This is an especially beneficial tool in Pennsylvania because the state offers affirmative defense for alcohol sales when ID scanning is used.
