Maryland recently passed SB 1041 which allows for alcohol to be delivered to individual homes by approved retailers. SB 1041 will require these licensed retailers to verify an individual’s date of birth upon delivery of said alcohol. A person may verify age using a government-issued photo ID and in direct face-to-face exchange including the assistance of any electronic or mechanical device. The new law went into effect July 1, 2024.
What does Maryland SB 1041 mean?
In short, Maryland SB 1041 allows for delivery of alcoholic beverages from permitted businesses. The bill specifies that the receiver of the order must be at least 21 and that their ID must be verified in-person at the time of delivery. Businesses can use an ID scanner to check a customer’s ID as a means of verifying age for these alcohol deliveries. While there is no designated age verification system that has been chosen by the Director of Alcohol, Tobacco & Cannabis Commission at this time, we are keeping a close watch on the progress and will provide updates on compliant identity verification systems as they are approved by the state.
